Cupertino Pedestrian Killed by Big-Rig Truck

A tragic pedestrian accident claimed the life of a Cupertino woman on January 15, 2013.  The victim has been identified by the Santa Clara County Medical Examiner’s Office as 79-year-old Xiulin Du of Cupertino.  According to published reports, Ms. Du was crossing Cupertino Road in a marked crosswalk when she was struck by a big-rig delivery truck.  The truck was owned and operated by Sysco, a national foodservice corporation.  At Matiasic Roth & Johnson LLP our hearts and sympathy remain with the victim and her family.

This preventable accident occurred around 7:00 a.m. at the intersection of Cupertino Road and Foothill Boulevard.  Sadly, the majority of pedestrian accidents occur at or near intersections.  Sometimes there are elements of the intersection itself that contribute to an environment that is dangerous for pedestrians.  For example, an intersection can lack adequate signage, be poorly designed, or have improperly functioning traffic signals.

A state or municipal entity may share some of the liability if this tragic accident is found to have resulted from an unsafe intersection.  There are strict deadlines that must be complied with to file a claim against a state or municipal entity.  If you or a loved one have experienced a pedestrian accident it is imperative that you contact a pedestrian accident lawyer immediately to preserve your rights.

In addition to the potential liability of a public entity, the truck driver and his employer may also share responsibility for this tragic accident. Investigators are still determining if driver negligence contributed to this heart wrenching accident.  Some common examples of driver negligence include: aggressive driving, driver confusion, driver intoxication and driver inattentiveness.

There is no amount of financial compensation that can bring back a life that has been cut short due to a pedestrian accident.  Nevertheless, families that have experienced the wrongful death of a loved one deserve compensation to help facilitate the painful process of rebuilding their lives.

The experienced pedestrian accident lawyers at Matiasic Roth & Johnson LLP are committed to making sure that pedestrian accident victims and their families get the compensation they deserve.  Call the legal team of Matiasic Roth & Johnson LLP for a free consultation with one of our experienced pedestrian accident lawyers.  We can provide you with a free case evaluation and help explain your rights.

Tragic Bicycle Accident Claims the Life of Redwood City Teenager

Redwood City residents are mourning the loss of Woodside High School student Leyla Beban. Leyla was involved in a tragic bicycle accident while on her way to school at approximately 8:30 a.m. on November 26, 2012.

Redwood City Police Department officials have indicated that Leyla was struck by a pickup truck as she was turning onto southbound Alameda de las Pulgas from Jefferson Avenue. Immediately following the accident, Leyla was transported to Stanford Hospital where she was pronounced dead. At Matiasic Roth & Johnson LLP our thoughts and prayers are with the Beban family in their time of immeasurable grief.

Teachers, classmates, and friends remembered 14-year-old Leyla as an ambitious, open-minded, kind person. A tree on the Woodside High School campus where Leyla and her friends would often meet was decorated with paper flowers and messages. Mourners also left flowers and stuffed animals at the intersection of Jefferson Avenue and Alameda de las Pulgas.

Redwood City Police Detectives are investigating the cause of this accident. Some common causes of bicycle accidents include: unsafe lane changes, motorists slamming on the brakes, left turns in front of an oncoming bicycle, inattentive motorists, and aggressive motorists who refuse to share the road with bicyclists. The driver of the pickup truck can be held liable for this terrible accident if driver negligence is found to have contributed to this bicycle accident.

Tragedy in Daly City After Minivan Strikes Pedestrians

A tragic pedestrian accident took the life of one young victim and left two other victims with life-threatening injuries. This horrific accident occurred on Saturday October 6, 2012 at approximately 9:00 a.m. in Daly City, California.
According to published reports, the victims were walking through the parking lot at Saint Andrew Catholic Church on Southgate Avenue when they were struck by a Toyota minivan.  The three victims were treated at the scene before being transported to San Francisco General Hospital.

Tragically, one of the victims was unable to recover from her injuries and was pronounced dead at the hospital.  The young victim has been identified as 6-year-old Danielle Naval of Daly City.  The other two victims reportedly sustained undisclosed life threatening injuries.  At Matiasic Roth & Johnson LLP our thoughts and prayers are with the victims and their families.
Pedestrian accidents can cause a lifetime of heartache in an instant.  Families are torn apart and lives are shattered in a fleeting moment of driver negligence.  The pain associated with losing a loved one in a preventable pedestrian accident is unimaginable.

The driver of the Toyota minivan has not yet been identified by authorities.  The cause of this tragic accident also remains unclear.  However, based on the fact that the accident occurred in a parking lot during daylight it appears that driver negligence may have contributed to this accident.

A driver of a car or truck has an enormous responsibility to ensure the safety of pedestrians.  Sadly, pedestrian accidents often occur when drivers are not paying attention to the roadway.  Drivers can be distracted for a multitude of reasons including: talking on the cellphone, texting, eating, fiddling with the radio or putting on makeup.  If a driver’s attention is not completely focused on the road, the safety of pedestrians is put at risk.

The experienced trial lawyers of Matiasic Roth & Johnson LLP are dedicated to helping victims of pedestrian accidents.  We fight for those whose lives have been devastated as a result of pedestrian accidents.  Our goal is always to get our clients the financial compensation they deserve to help rebuild their lives.  Call our legal team today for a free consultation.

Cupertino Boy Killed After Being Struck by Car

A heart-wrenching accident occurred on July 17, 2012, in Cupertino, California.  The scene of the accident was the Vista Creek neighborhood which is located near the intersection of Stevens Creek and De Anza Boulevards.  The victim has been identified by the Santa Clara County Coroner’s Office as 5-year-old Amartya Chinya.

According to published reports, Amartya was riding a scooter in a cul-de-sac near his home when he was struckby a Ford Focus that was backing out of a driveway.   The victim was transported to a local hospital where he eventually succumbed to his injuries.  Preliminary reports indicate that he was wearing a helmet at the time of the collision.  At Matiasic Roth & Johnson LLP our thoughts and prayers remain with the victim’s family.

Investigators are still trying to determine why the driver did not see the child.  The Santa Clara County Sheriff’s Office does not suspect that drugs or alcohol contributed to this horrific accident.  One possible factor in this tragic accident is driver inattention.    A driver cannot operate his or her vehicle safely if they are distracted.  Common examples of activities that distract drivers include: texting, eating, talking on a cell phone, changing the radio station or applying makeup.  The driver can be held liable for causing this accident if driver inattention was a contributing factor.

On June 21, 2012, a pedestrian was killed in Mountain View.  The accident occurred on California Street near the intersection of Escuela Avenue at approximately 9:30 a.m.  According to published reports, the victim was waiting at a bus stop when he was hit by an Audi sedan that was travelling eastbound on California Street.  The victim has been identified as 50-year-old William Ware of Mountain View.  Mr. Ware was reportedly dead by the time emergency personnel arrived at the scene.  Our thoughts and prayers are with the victim’s family in their time of immense grief.
