Two Juvenile Cyclists Injured in East San Jose

A freighting bicycle accident in East San Jose left two juveniles with serious injuries.  The accident occurred on January 15, 2013, at approximately 5:35 p.m. on Alum Rock Avenue near the intersection of Eastgate Avenue. 

According to published reports, the young cyclists were crossing Alum Rock Avenue when they were struck by a truck that was traveling westbound on Alum Rock Avenue.

Cupertino Pedestrian Killed by Big-Rig Truck


A tragic pedestrian accident claimed the life of a Cupertino woman on January 15, 2013.  The victim has been identified by the Santa Clara County Medical Examiner’s Office as 79-year-old Xiulin Du of Cupertino.  According to published reports, Ms. Du was crossing Cupertino Road in a marked crosswalk when she was struck by a big-rig delivery truck.  The truck was owned and operated by Sysco, a national foodservice corporation.  At Matiasic Roth & Johnson LLP our hearts and sympathy remain with the victim and her family.

Chico State University Student Critically Injured in Pedestrian Accident

A tragic pedestrian accident shocked the Chico State University community on Saturday December 8, 2012. Chico Police Department Officials have indicated that 21-year-old student Brandon Fisher was struck by a Chevy pickup truck at the intersection of Walnut Street and West First Street. The victim was transported to Enloe Medical Center where he is reportedly fighting for his life.  At Matiasic Roth & Johnson LLP our thoughts and prayers are with Brandon in hopes that he makes a complete recovery.

The driver of the pickup truck was arrested shortly following the accident. According to unconfirmed reports, 20-year-old Butte College student Mathew Lambert was arrested on suspicion of DUI.

Mountain Biker Struck by Car in San Francisco's Presidio

A frightening bicycle accident occurred in San Francisco on November 12, 2012, at approximately 10:00 a.m.  According to published reports, 26-year-old Garrett Gibson was riding his mountain bike north on Lincoln Boulevard in the Presidio when he was struck by a black Porsche Cayenne.  Mr. Gibson was violently thrown off his bike and knocked unconscious.  After the collision, Mr. Gibson’s mountain bike became pinned to the front of the Porsche.  The driver of the Porsche fled the scene of the accident with the bicycle still pinned underneath the bumper.  The mountain bike has yet to be recovered. 

It is unfathomable that someone could strike another human being with their car and not even stop to administer aid or call for help.  Tragically, this type of deplorable behavior is far too common on California roadways.  Recent unconfirmed reports have indicated that the driver may have turned herself in to local police.

San Ramon Pedestrian Critically Injured After Hit-and-Run Collision

An elderly pedestrian suffered critical injuries after being struck by a car.  This terrible accident occurred on November 9, 2012, at the intersection of Village Parkway and Alcosta Boulevard in San Ramon, California.  The 82-year-old victim was immediately transported to a local hospital.  At Matiasic Roth & Johnson LLP our thoughts and prayers are with the victim in hopes that he recovers from his injuries.

Santa Rosa Pedestrian Suffers Severe Injuries After Being Struck By Car


A tragic pedestrian accident occurred in Santa Rosa on October 20, 2012.  According to published reports, the scene of the accident was the east side of Mission Boulevard near Randall Lane.  This stretch of Mission Boulevard is heavily traveled by motorists as a thoroughfare between Montecito Boulevard and Highway 12. 
Early reports indicate that that the victim, who appeared to be a man in his twenties, was in the crosswalk when he was struck by the car.  Fortunately, a Kaiser Permanente emergency room nurse was nearby when the accident occurred.  He was able to provide some emergency care until paramedics arrived on the scene. Cyclist Dies After Being Struck by Big-Rig Truck in Stockton


A deadly bicycle accident occurred on October 9, 2012, in Stockton, California.  The scene of the deadly crash was the Fremont Street crossing over Highway 99.  According to a California Highway Patrol spokesperson, an unidentified cyclist was riding a silver mountain bike in the bike lane when he was struck by a big-rig truck.  The cyclist reportedly went under the big-rig truck after impact.  Sadly, the cyclist was pronounced dead at the scene of the accident.  Our thoughts and prayers are with the victim and his family.

A fatal bicycle accident occurred in Berkeley, California on July 13, 2012. The victim was 65-year-old Shlomo Bentin. Mr. Bentin was a distinguished Israeli psychologist from Hebrew University of Jerusalem. Last year Mr. Bentin was awarded the prestigious Israel Prize in recognition of his contributions in the field of psychology and neuropsychology. Mr. Bentin was residing in Berkeley with his wife for the past year while working as a visiting professor at U.C. Berkeley.  

According to published reports, Mr. Bentin was riding his bicycle on Bancroft Way near the intersection of Fulton Street at approximately 3:30 pm when he was struck by a passing dump truck. The driver of the truck reportedly did not notice striking Mr. Bentin. A motorcyclist who was at the scene chased down the dump truck and notified the driver that he had struck Mr. Bentin. The dump truck driver returned the scene and cooperated with investigators.

A Berkeley Police Department spokesman recounted that Mr. Bentin had suffered significant head trauma. His bicycle helmet had reportedly been shattered into several pieces. Professional Cyclist Injured after Hit-and-Run Collision in Alexander Valley

A professional cyclist from New Zealand is in critical condition after being struck by a car in northern Sonoma County. On June 29, 2012, twenty-six-year-old Michael Torckler was on a training ride on Pine Flat Road in Alexander Valley. Pine Flat Road is dead-end road in the vicinity of Highway 128. It is popular among cyclists because it lightly travelled, picturesque, and steep. 
According to published reports, Torckler was riding downhill when he was struck by a car that was travelling uphill. The driver fled the scene following the accident. California Highway Patrol investigators put a bulletin out for a black Honda Accord. The next day, thirty-six-year-old suspect Arthur Ben Yu was arrested at his home in Rohnert Park. Preliminary reports suggest that Yu was intoxicated at the time of the accident. 
Following the collision, Torckler was airlifted to Santa Rosa Memorial Hospital. Torckler was reportedly in critical condition after suffering major facial fractures. Fortunately, it is reported that Torckler's injuries are no longer considered to be life threatening and he did not sustain any major brain trauma. Southern California Cyclist Killed Near Bodega Bay

A tragic bicycle accident occurred on May 31, 2012 on Highway 1 near Bodega Bay.  The victim was 85-year-old August Bissiri.  Mr. Bissiri was an avid cyclist who was participating in a bicycle tour of Sonoma County.  Mr. Bissiri, a retiree from the Southern California community of Laguna Woods Village, had met up with other cyclists from the Bicycle Club of Irvine and the Laguna Woods Village Bicycle Club to ride a 100 mile tour of Sonoma County in conjunction with an annual fundraiser for Guatemalan charities.

According to the California Highway Patrol, Mr. Bissiri was struck by a Ford Focus that was driven by Berkeley resident David Tryon.  Mr. Tyron told investigators that he was traveling northbound on Highway 1 when he saw the cyclist and was unableto avoid contact.  Mr. Bissiri was pronounced dead at the scene. 

It is unclear if driver inattention, excessive speed or aggressive driving had any role in this terrible accident.  Due to their lack of physical protection, cyclists are at a high risk of injury from any instance of driver negligence.

Fatal Accident Takes the Life of Cyclist in Napa

A tragic accident took the life of 56-year-old Alfredo Hernandez Pedroza. Mr. Pedroza was a long time Napa resident and father of Napa City Council candidate Alfredo Pedroza. At Matiasic Roth & Johnson LLP our sincere condolences go out to the victim's family in their time of immense grief.

The horrific accident occurred on May 17, 2012, at approximately 6:30 pm. The victim was riding his bicycle on Silverado Trail near Yountville Cross Road when he was struck by a Ford hatchback that was traveling southbound at approximately 55 mph. According to published reports, the victim died instantly following the collision.

The driver of the car has been identified as 20-year-old Calistoga resident Cammie Muntz. She reportedly told California Highway Patrol officers that she had fallen asleep behind the wheel and veered off the road prior to the collision. It is unclear if drugs or alcohol had any role in this accident.

Cyclist Killed in Hit and Run Accident in Dublin

A gruesome accident resulted in the death of a cyclist on May 15, 2012. The accident occurred around 11:30 p.m. on Doherty Road near Fall Creek Road in Dublin, California. According to published reports, the victim was identified as 57-year-old Bo Hu of China. The victim was riding his bike along Doherty Road when he was struck by a car which fled the scene of the accident.  A passerby called 911 and the responding paramedics pronounced the victim dead at the scene of the accident. 

Investigators analyzed some vehicle parts and debris which were found at the scene and determined that it came from a 2012 Mercedes Benz. The police investigation eventually led to the home of a 32-year-old San Francisco attorney who lives less than three miles from the scene of the accident. Police discovered a black Mercedes Benz with significant front end damage in the garage. Spencer Freeman Smith was arrested for gross negligence and felony hit-and-run in connection with the accident.
